Terms of Service — ZimexDubai

1. Who these terms apply to

These terms govern your use of zimexdubai.com and any purchase made through us. By using the site or placing an order you agree to them. If you do not agree, please do not use the site.

2. About us

ZimexDubai is an online retail business operating from Harare, Zimbabwe, serving customers across Zimbabwe and surrounding markets since 2016. You can reach us by email at orders@zimexdubai.com or via our contact page.

3. Eligibility

You must be at least 18 years old, or have your parent or guardian's consent, to place an order. By placing an order you confirm that the personal information you provide is accurate and that you have the legal authority to make the purchase.

4. Your account

You are responsible for keeping your account credentials secure. Notify us promptly if you suspect unauthorised access. You may close your account at any time via your account page or by emailing us.

5. Product information

We make every effort to describe products accurately, including model, region variant, included accessories, and warranty terms. Manufacturer images and specifications are shown for reference; minor variations in packaging or accessories may occur between production batches. If anything material is misrepresented, please tell us and we will correct it within one business day.

6. Pricing and currency

All prices are in US Dollars (USD) unless stated otherwise. ZWG equivalents are shown at the official Reserve Bank of Zimbabwe (RBZ) interbank rate at the time of checkout. Prices are subject to change without notice; the price applicable to your order is the price displayed at the moment you confirm the order.

If we discover a pricing error after you place an order, we will contact you to either confirm the order at the correct price or cancel it for a full refund. We do not knowingly use deceptive pricing or fake "was / now" comparisons.

7. Orders and acceptance

A confirmation email or message acknowledging your order is not acceptance of your order. We reserve the right to refuse or cancel orders, including for reasons of:

Stock unavailability after we attempt to source the device.
Pricing or product description errors.
Suspected fraud or chargeback risk.
Inability to verify the delivery address or the buyer's identity.
Restrictions imposed by sanctions or export-control law.

If we cancel an accepted order we refund any amount you have paid within 5 business days.

8. Payment

We accept EcoCash, OneMoney, Visa and Mastercard via Paynow and Pesepay, PayPal, ZIPIT, and cash on delivery in USD. Payment must clear before we dispatch the device, except in cash-on-delivery arrangements expressly confirmed by us at the time of order.

You authorise us to verify your payment details and to use the payment method indicated at checkout. We do not store full card numbers — those are handled by our PCI-DSS-compliant payment providers.

9. Delivery and risk

Delivery terms are set out in our Shipping Policy. Risk of loss transfers to you when the courier hands the device to you and collects your signature or acceptance confirmation. Until that moment, ZimexDubai is responsible for the parcel.

10. Returns, refunds, warranty

Returns, refunds, and warranty service are governed by our Returns Policy and Warranty Policy, each forming part of these terms. Nothing in these terms limits your statutory rights under Zimbabwe's Consumer Protection Act (Chapter 14:14).

11. Acceptable use

You may not use zimexdubai.com to:

Place orders fraudulently or with stolen payment instruments.
Resell devices in a way that misrepresents ZimexDubai's warranty.
Reverse-engineer, scrape, or copy substantial portions of the site for commercial purposes.
Probe or attempt to compromise the security of the site or its infrastructure.
Submit deliberately false reviews, ratings, or feedback.

12. Intellectual property

The ZimexDubai name, logo, website design, and original content are owned by us or our licensors and are protected by Zimbabwean and international copyright and trade mark law. Product images, brand names, and trade marks belonging to manufacturers (Apple, Samsung, etc.) remain the property of those manufacturers and are used here solely to identify the products we sell.

13. User-submitted content

If you submit a review, comment, or photo to us, you grant ZimexDubai a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content in connection with the relevant product or service. You confirm that your submission is accurate, your own work (or used with permission), and not defamatory or unlawful.

14. Third-party links

zimexdubai.com may link to third-party sites (manufacturer pages, IMEI checkers, payment providers). We are not responsible for the content, policies, or practices of those sites.

15. Limitation of liability

To the maximum extent permitted by Zimbabwean law, ZimexDubai's aggregate liability arising out of or in connection with any single order is limited to the amount paid for that order. We are not liable for indirect, incidental, or consequential losses such as loss of profit, loss of data, or business interruption.

Nothing in these terms excludes or limits our liability for:

Death or personal injury caused by our negligence.
Fraud or fraudulent misrepresentation.
Any liability that cannot lawfully be excluded under Zimbabwean consumer law.

16. Force majeure

We are not liable for delays or failures in performance caused by events beyond our reasonable control, including flight delays, customs disruption, currency restrictions, power outages, telecommunications failure, civil unrest, public-health measures, or acts of government.

17. Privacy

Our processing of personal data is governed by our Privacy Policy, which forms part of these terms.

18. Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top of this page tells you when. Material changes will be notified by email to registered customers. Your continued use of the site after a change constitutes acceptance of the updated terms.

19. Governing law and jurisdiction

These terms are governed by the laws of Zimbabwe. Any dispute arising out of or in connection with these terms or any purchase made through us is subject to the exclusive jurisdiction of the courts of Zimbabwe.

20. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions remain in full force and effect.
